Terms of Service
Effective date: 25 August 2026. These terms apply to the EstateMarshal service at estatemarshal.com and to every report we deliver. Read them with our Privacy Policy. They are written in plain English on purpose.
1. Who we are and who we serve
EstateMarshal ("we", "us") is a private research service operated by Inshal Mesiya. We are not affiliated with any government agency. Searching and claiming unclaimed property is free directly from each state.
Our service is available only to professional advisors acting for an estate: attorneys, certified public accountants, and other licensed professionals who are not themselves the owner, heir, executor, personal representative or trustee of the property searched (each a "Customer"). By ordering a report you confirm that you are such an advisor and that you are not ordering as, or on behalf of, an owner or claimant under any agreement to locate or recover property for a fee.
2. What the service is
For a named deceased person (the "Decedent") whose details you supply (the "Profile"), we search publicly published unclaimed-property records and other public sources under the names and addresses in the Profile and deliver a written research report (the "Report"). The Report lists what the public records showed on the dates stated in it, the official instructions and links for claiming, and the names, sources and dates we searched.
The Report is a research product. It is not legal, tax or financial advice, it does not determine who is entitled to any property, and it does not file, prepare or submit any claim. You decide what to do with it.
3. What the service is not
We never: contract with, solicit or take payment from owners, heirs, executors or personal representatives; take a percentage of any property; file claims; hold a power of attorney; draft claim letters for heirs; contact owners or heirs; or collect Social Security numbers. Sources that require a Social Security number or identity verification (for example TreasuryHunt or the federal Retirement Savings Lost and Found) are listed in the Report as steps for the fiduciary to run.
4. Accuracy and limits
Public records are incomplete, contain errors, and change. Each listing in a Report is as of the state bulk file or portal on the date shown, and may already have been claimed, paid, corrected or removed. Name matching is probabilistic: a listing may belong to a different person with a similar name, and property held under a name or address not in the Profile will not be found. You must verify every listing directly with the holding state before relying on it or filing anything. We do not guarantee completeness, currency, or that any property exists or is recoverable.
5. Ordering, fees and payment
Reports are ordered per Decedent at the flat fee stated at the time of order, plus any applicable taxes. Fees do not depend on what is found or recovered. Free reports offered during our evaluation period carry the same terms except for payment. Invoices are payable within 30 days by the methods we state; overdue invoices may pause further orders. Fees are non-refundable once a Report is delivered, except where we failed to deliver a Report at all.
6. Your responsibilities
You are responsible for the accuracy of the Profile and for having the authority to supply the personal data in it. You will use the Report only in the course of your professional engagement for the estate. You will not resell the Report or the service, use it to solicit owners or heirs, or extract data from it to build a database. You will not attempt to access our systems other than through the interfaces we provide.
7. Confidentiality and data
We treat Profiles and Reports as confidential. We keep case data only as long as our Privacy Policy states (90 days after a case is closed unless you have an active re-check subscription) and then delete it. We do not sell personal data.
8. Intellectual property
The Report is yours to use within your engagement. The format, templates, software, indexes and know-how behind the service remain ours. Public records remain public.
9. Liability
To the fullest extent the law allows, our total liability for any claim connected with the service is limited to the fees you paid us for the Report concerned in the twelve months before the claim arose, and we are not liable for indirect, consequential or lost-opportunity damages, including any property not found, not claimed or not recovered. Nothing in these terms limits liability that cannot be limited by law.
10. Changes, suspension and termination
We may update these terms; the effective date at the top changes when we do, and material changes are notified to Customers by email before they take effect. We may suspend or end service to a Customer who breaches section 1 or 6. You may stop using the service at any time; sections 4, 7, 8 and 9 survive.
11. Governing law and disputes
These terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Before starting any proceeding, both sides agree to try to resolve the dispute by email correspondence for 30 days. Courts located in Wyoming have exclusive jurisdiction thereafter.
